The new cockpit voice recorder transcript on Smolensk crash is a provocation, says Dr. Gruszczyńska- Ziółkowska, Ph.D.

SCND: April 8, 2015

Warsaw, Poland in the aftermath of the Smolensk Plane Crash.

RMF FM has recently published CVR transcripts of the Tu-154 which crashed in Smolensk. Allegedly, by means of a different method, it was possible to retrieve more information from the CVR. The new transcript seems to confirm information from the MAK report – chaos in the cockpit, pilots under pressure and the presence of General Błasik in the cockpit. Is it possible that the new transcript is a breakthrough?

Prof. Anna Gruszczyńska-Ziółkowska: When I read or hear media reporting on the alleged new transcript, I get the impression that those reports have little to do with the actual tragedy in Smolensk. They are more of a political provocation. I expect the prosecution to verify if the published materials are indeed excerpts of the new transcript and if yes, to explain whose decision it was to make such evidence public. Also, if an excerpt has been made available, we might as well have the full transcript published and the information about the team of experts who worked on it. I have hopes that other experts, e.g. who attended the Smolensk Conference or who are part of the Parliamentary Committee will be given access to the new audio recording to verify the new transcript. As it stands, no access has been granted, not even to the excerpts of the new material.

Does it matter who the experts are?

It remains an open question who listened to the recording, who deciphered the words and phrases and who identified the voices in the new expertise. How many people worked on the transcript? In such an important case it should be obvious that every single word and phrase should be consulted. Therefore, the prosecution should disclose the names of the experts. They are, after all, funded by taxpayers, so their identity should not be confidential.

On April 7, 2015, new transcripts from black boxes of the Tu-154, which crashed in Smolensk, have been published by RMF radio. The Chief Military Prosecution Office announced back then that the published excerpt contained a series of inaccuracies, and published a transcript from the new CVR copy, together with experts’ opinions, on its website.

The published transcript presents the last 40 minutes of the Tu-154 flight. In the transcript, a person named DPS (not specified in the transcript, but media indicate General Andrzej Błasik, the Air Force Commander – in Polish, Dowódca Sił Powietrznych, so DPS) is heard during the final phase of the flight. The CVR is said to have been processed with the use of new methods, which helped to improve its quality and readability, with the transcript being a result of a several month work by a team of experts.

The transcripts, disclosed by the District Military Prosecution in Warsaw, who leads the Smolensk crash investigation, come from a complex expert opinion regarding causes of the Smolensk crash. A part of that complex opinion was an analysis of the new Tu-154 CVR copies. The new copies have been made in Moscow back in February 2014 by Polish experts.

Is it really possible that the team of experts, by means of the new method, could produce a clearer version of the Tu-154 transcript?

Technically it is possible. We know that Polish experts went to Moscow and made new copies. However, we don’t know who those experts are. I hope that the original recording was not damaged when new copies were made and that it can still be used for further copies in the future. I am not saying that the experts who made the copies are bad or that their intentions are bad, since nothing is known about them! This lack of knowledge gives us no reason whatsoever to have trust in the published materials they produced. I find it bizarre that we don’t even know the names of those experts. Who, and based on what qualifications, made the copies in Moscow? The only information revealed by prosecutors is that one of the experts is Andrzej Artymowicz. On what grounds was he recognised as an expert and what experience does he have in retrieving CVR MARS-BM? Has he done it before or has he just experimented using highly sensitive material? According to the public data on Mr. Artymowicz, he is a film sound producer, working for Playboy. What then, was Mr. Artymowicz’s specific role in the team of experts? Was there any other expert on that team with more adequate qualifications?

We can also question the authenticity of the Moscow materials. Can it be doubted?

The new copies were made in February 2014. Did the experts deliver them to Warsaw personally? No, they left the copies in Moscow, as, according to the Chief Military Prosecution Office, the copies arrived a few months later, in May. Since Polish experts go to Russia to make CVR copies in the presence of Russians, and then leave Russia without them, allowing those copies to stay in Russia for a further few months, is there any wonder that the value of those copies is being doubted? Until we get a chance to examine those copies, the doubt regarding their authenticity is fully justified.

Red Notice by Bill Browder

From the Editor's Desk: A real-life political thriller about an American financier in the Wild East of Russia, the murder of his principled young tax attorney, and his dangerous mission to expose the Kremlin’s corruption.

In 2007, a group of law enforcement officers raided Browder’s offices in Moscow and stole $230 million of taxes that his fund’s companies had paid to the Russian government. Browder’s attorney Sergei Magnitsky investigated the incident and uncovered a sprawling criminal enterprise. A month after Sergei testified against the officials involved, he was arrested and thrown into pre-trial detention, where he was tortured for a year. On November 16, 2009, he was led to an isolation chamber, handcuffed to a bedrail, and beaten to death by eight guards in full riot gear.

The Man Without A Face by Masha Gessen

From the Editor's Desk: A chilling and unflinching portrait of one of the most fearsome figures in world politics.
In 1999, the “Family” surrounding Boris Yeltsin went looking for a successor to the ailing and increasingly unpopular president. Vladimir Putin, with very little governmental or administrative experience - he’d been deputy mayor of St. Petersburg, and briefly, director of the secret police - nevertheless seemed the perfect choice: a “faceless” creature whom Yeltsin and his cronies could mold in their own image. Russia and an infatuated West were determined to see in him the progressive leader of their dreams - even as Putin, with ruthless efficiency, dismantled the country’s media, wrested control and wealth from the business class, and destroyed the fragile mechanisms of democracy.

Blowing Up Russia by Aleksander Litvinenko and Yuri Felshtinsky

From the Editor's Desk: "Blowing Up Russia" contains the allegations of ex-spy Alexander Litvinenko against his former spymasters in Moscow which led to his being murdered in London in November 2006. In the book he and historian Yuri Felshtinsky detail how since 1999 the Russian secret service has been hatching a plot to return to the terror that was the hallmark of the KGB.

Vividly written and based on Litvinenko's 20 years of insider knowledge of Russian spy campaigns, Blowing Up Russia describes how the successor of the KGB fabricated terrorist attacks and launched a war. Writing about Litvinenko, the surviving co-author recounts how the banning of the book in Russia led to three earlier deaths.

Destruction of Evidence
Smolensk Crash: Destruction of evidence.
Already during the first night of the crash, the Russians were removing the most important pieces of evidence from the crash site, that is, the remains of the Polish President’s Tupolev, TU-154M. Parts of the aircraft were transported away without any prior planning, and some of them were purposefully destroyed. Read more here
"Russian Image Management"

The trip to Smolensk was expected to highlight Russia finally admitting culpability in the massacre, after long having blamed it on the Germans, an atrocity they had tried to conceal for over 70 years.

Eugene Poteat, retired CIA Senior Scientific Intelligence Officer.

As for the reception committee, it had different ideas. Putin wasn’t looking forward to such an occasion. Into this poisonous reception brew was President Kaczynski’s well-known public criticism of Moscow and Putin, a habit that has ended the lives of others within Russia – and abroad. A few discouraging Russian requirements – that Kaczynski could not attend in any official capacity – did not halt the Poles. Kaczynski would go anyway on non-official, “personal” business. To Russians, such a distinction would be meaningless, not lessening the possible international excoriation of such an event. A problem ripe for a modern, Russian solution: a tragic, ‘natural’ accident.

Dr. Michael Baden Interview
Dr. Michael Baden, Ph.D.
World-renowned forensic pathologist goes on the record: "I have been doing autopsies for 50 years, and I've investigated more than fifteen, twenty airplane crashes […] I've been in countries all over the world where families think that the government is hiding something. Whether it is Zimbabwe or Israel, or Philippines, the government may not like an outside person checking to make sure they got it right. [But,] they never interfered with that. The family, the next of kin, always has the right to do what the wishes of the family are. In the 21st century, the body of the dead person no longer belongs to the state. It belongs to the family. So, it is unusual - something that I have never experienced before - where the government [of Poland] has not permitted the famil[ies]" to conduct independent forensic examinations of their loved ones' remains [...] I've never heard of a body coming back to a country and the family being unable to open up a casket. I've never heard of the family not being able to get an autopsy… Read more here
